Q. Pre-Order Terms & Conditions

UNIQLO CO., LTD. (hereinafter "our company") has established the following terms and conditions (hereinafter "these terms and conditions") for the sale of our products designated by our company as available for pre-order (hereinafter "pre-order sales"). For matters not stipulated in these terms and conditions, the terms, and conditions of our company's online store (hereinafter "online store terms and conditions") shall apply. 

 

Article 1 (Scope of Application of These Terms) 

These terms and conditions apply to Customers (hereinafter "Customers") who purchase products on pre-order at our online store (hereinafter "Online Store"). By applying to our company to purchase a product on pre-order, Customers are deemed to have agreed to the contents of these terms and conditions. 

Article 2 (Application for Pre-Order) 

  1. When purchasing a product related to a pre-order sale, the Customer shall apply to purchase the product by providing the information specified by our company, in accordance with the conditions and methods specified by our company. 

  1. If it is found that the Customer has previously had their membership canceled due to a violation of the terms of use of an online store operated by us or our affiliates, if it is found that the Customer has previously resold products of us or our affiliates to a third party, if the information entered contains false information, or if we otherwise deem it inappropriate to accept a pre-order, we may not accept your application for a pre-order. 

  1. When the Company accepts an application as set forth in paragraph 1, the Company will send the Customer an email to his/her email address containing information such as the expected delivery date of the product related to the application. 

  1. If there are any changes to the delivery address, name, telephone number, credit card information or other payment information that you specified to us when applying for a pre-order before the delivery of the product related to the pre-order, you must notify us using the method separately specified by us. 

Article 3 (Credit and Settlement) 

  1. Payment for products and other expenses related to pre-orders shall be made by credit card designated by our company (lump sum payment), (unless otherwise specified by our company), or other method designated by our company. 

  1. The Customer will provide us with their credit card information when applying for the pre-order sale. After providing such information, a credit check will be conducted for the credit card entered when applying for the pre-order sale.  

  1. After the credit approval based on the screening in the previous paragraph, a credit limit equivalent to the payment amount for the pre-order sale will be secured from the credit card's available credit. After the credit approval based on the screening in the previous paragraph, we may conduct a credit review and obtain credit again at each of the following times and after a certain period of time has passed after the credit approval based on the screening in the previous paragraph: 
    (1) When the pre-ordered product arrives at the warehouse designated by our company and is recorded as inventory. 
    (2) When the pre-ordered product is ready to be shipped to the Customer from the warehouse designated by our company. 

  1. We will only ship products to Customers who choose to pay by credit card and for whom credit or credit limit has been secured and payment has been completed through the screening based on paragraphs 2 and the preceding paragraph. 

  1. For Customers who have chosen to pay by credit card, payment for pre-ordered products will be made at the time specified in paragraph 3(2). 

Article 4 (Delivery, delivery time, etc.) 

  1. As soon as the reserved product is ready for shipping, we will deliver it to the address specified by the Customer when applying for the pre-order sale. However, the Customer understands that due to the nature of pre-order sales, a certain amount of time is required for the product to be delivered and accepts in advance that the delivery time of the pre-ordered product may be later than the expected delivery time of the product notified in Article 2, Paragraph 3 due to the product manufacturing status, delivery status, or other reasons. 

  1. When a Customer places an order for multiple products related to pre-order sales, or when a Customer places an order to purchase products other than the products that are subject to pre-order sales in addition to the products that are subject to pre-order sales, the Customer cannot specify the order or timing of delivery of each product, and the order or timing of delivery may be as specified by our company. 

Article 5 (Handling of Customer Information) 

  1. We will handle the information obtained from Customers in relation to pre-order applications in accordance with our Privacy Policy

  1. As a rule, we will not disclose any information obtained from Customers to third parties. However, we may disclose such information to the minimum extent necessary to contractors who handle pre-order sales-related tasks, such as product delivery. 

Article 6 (Cancellation of Pre-Order) 

  1. Once a sales contract for a pre-order has been concluded, the Customer may  cancel the a pre-order within 30 minutes after a pre-order has been placed.  

  1. In the event of any of the following events, we may immediately cancel the pre-order sales without prior notice. 
    (1) If the Customer has violated or is likely to violate these terms, the online store terms of use, or the online store terms of use of our affiliated companies. 
    (2) If the Customer has defaulted or is in the past in fulfilling obligations related to the services related to pre-order sales or transactions through this online store. 
    (3) If the credit check for the credit card designated by the Customer is not approved based on Article 3, paragraph 1, or if the credit limit for the debit card is not secured and the settlement is not completed (including cases where a second credit check, the securing of the credit limit, and the settlement based on Article 3, paragraphs 3 and 4 are not approved or not completed). 
    (4) If the product cannot be delivered to the Customer or the Customer refuses to receive the product due to an unknown delivery address, long absence, or other reasons not attributable to our company. 
    (5) If a pre-order application is made by a minor. 
    (6) In addition to the above, if the Customer has acted in a manner that our company reasonably deems inappropriate, or if we deem it appropriate to cancel the pre-order sales. 

Article 7 (Disclaimer) 

  1. If our company has an obligation to notify a Customer, it will consider that it has fulfilled that obligation by notifying the Customer to the email address entered in advance by the Customer, and in the case of delivery of products related to pre-orders, by delivering the products to the delivery address specified by the Customer when applying for the pre-order. 

  1. We do not guarantee that pre-orders will suit any specific purpose of the Customer, that products related to pre-orders will have the expected commercial value, accuracy, or usefulness, or that the Customer's use of pre-orders will comply with the laws and regulations or internal rules of industry associations that are applicable to the Customer, or that there will be no defects. 

  1. Regardless of the legal basis for the claim, we shall not be liable for any damage, loss, disadvantage, etc. incurred by Customers in relation to the use of pre-order sales that is caused by reasons beyond the control of our company. 

  1. Customers shall be responsible for all communication costs and other expenses incurred in using the pre-order service. 

Article 8 (Priority Relationship) 
In the event of any discrepancy or inconsistency between the provisions of these Terms and the Online Store Terms of Use, the provisions of these Terms shall prevail.
